If you are an employer under one of the Department of Transportation's (DOT) six safety-sensitive agencies (FAA, FMCSA, FTA, USCG, PHMSA, FRA), it's crucial that you conduct a drug and/or alcohol test after your employee is involved in an accident. How Does the Post-Accident Testing Procedure Work?

First and foremost, the circumstances surrounding the accident will determine whether or not you need to conduct post-accident federal DOT testing.

In order to remain DOT-compliant, you must carry out post-accident testing if any of the following are true:

  • The accident resulted in the need for medical attention by any individual involved
  • The accident resulted in a fatality of any involved individual
  • The driver was cited for a moving violation as a result of the accident
  • Any vehicle involved in the accident could not leave of its own volition

If any of the above is true, you will need to conduct post-accident federal DOT testing. The FMCSA requires post-accident alcohol testing to take place within 8 hours after the incident, and all post-accident drug tests must take place within 32 hours.
