The device used to detect alcohol use, known as an evidential breath testing device, or EBT must be approved by the National Highway Traffic Safety Administration. Additionally, the EBT can only be operated by a certified breath alcohol technician.
Various circumstances will result in an automatic failed DOT alcohol test result, including:
- Refusal to take a breath alcohol test
- Refusal to complete and/or sign the testing form
- Refusal to provide adequate breath
- Test result of 0.04 blood alcohol content or higher
- Refusal to cooperate with any part of the testing process
